1.) Subject matter of the event visitor contract
In the case of an event visitor contract, the organiser undertakes to provide the event and the visitor undertakes to pay the agreed fee.
2.) Legal consequences if the visitor is prevented from attending
If the visitor is unable to attend the event for reasons for which he/she is responsible, he/she shall not be entitled to a refund of the fee.
3.) Legal consequences in the event of a delay in the event
In the event of a delay in the start of the event, the legal consequences shall depend on the duration of the delay. If the delay is only slight, the visitor may not withdraw from the contract. However, if the delay is more severe, the visitor may withdraw from the contract and claim back his admission fee.
4.) Legal consequences of a defective performance
If the performance is defective, the visitor can demand at least part of the entrance fee back. However, it is debatable when the event is defective.
5.) Legal consequences if the event is cancelled
In this case, the organiser must refund the admission fee, even if he is not responsible for the reason for the cancellation (e.g. bad weather at an open-air event). The amount depends largely on the type of event.
If you have any questions about the event visitor contract or other issues, I will be happy to advise you. It is not necessary for you to come to my office for this. You can send me your concerns in advance by email (also with attachments). I will then make you a non-binding offer for a mandate and, if necessary, contact you by telephone. A mandate only comes into effect when the mandate is issued in writing.
